THE VOLUNTARY TRANSMISION IN THE PRE-TRIAL PROCEEDINGS

Annotation

The report is related to the institute “voluntary transmission” regulated in art.159,p.1of the Criminal procedure code (CPC) аnd its place in the pre-trial proceedings. By nature the voluntary transmission is used mostly in the pre-trial proceedings and represents procedural action. In this regard the voluntary transmission can be defined as a written evidence tool according to art.127, p.1 of the CPC. The present report presents the practical advantage of using this institute as well some problems which arise in front of the pre-trial proceedings bodies regarding its application in the first stage of the pre-trial proceedings – “investigation”.
