ARE JURISDICTION DISPUTES ADMISSIBLE IN ORDER PROCEEDINGS

Annotation

 In this article the author addresses the issue which court has jurisdiction to issue writ of execution when the First Instance Regional Court refuses to issue such by an order, but the competent District Court finds that the prerequisites for issuing a writ of execution are met, as well as when it upholds the order of the Regional Court, however the Supreme Court of Cassation finds that a writ of execution must be issued. The author analyzes the relevant case law on this matter and also provides arguments in support of his opinion on the subject.
