Annotation
This paper provides a general overview of the different ways in which data is processed according Regulation (EU) 2022/868 (Data Governance Act) and Regulation (EU) 2023/2854 (Data Act), which have enhanced the legal framework for the right to information. It is provided an overview of the legal regimes for data processing and outlines the possibilities for data sharing by private entities.
Among the new possibilities outlined under the Data Governance Act are data intermediary services for processing data held by public sector organisations that are protected on various grounds under other legal regimes.
Various obligations for making available product data and related service data to the user of the connected product or related service and making available of data by data holders to data recipients under the Data Act, have been considered.
