THE INTERESTED LEGAL ENTITY AS A NEW PARTICIPANT IN THE CRIMINAL PROCEEDINGS – PART I

Annotation

This text does not aim to engage in serious theoretical polemics. It is provoked by a change in the Code of Criminal Procedure (CCP), which will certainly cause discussions, interpretations and difficulties in the coming months. We are talking about the change promulgated in the State Gazette, issue 61 of July 29, 2025 and which enters into force on October 31, 2025 (§61, item 1 of the Criminal Procedure Act in the specified issue of the State Gazette). Its most profound consequence is the introduction of a new participant in the criminal process: an interested legal entity. The legal framework is systematically contained among the regulations for participants in criminal cases in the new Chapter Seven “a” of the CCP.
