Annotation

The report examines the powers of the court within the proceedings regulated in chapter 21 of the Civil Procedural Code, in the light of the possible defects. It is argued that the classification of null, inadmissible and wrong is applicable regarding the court rulings, as well as that the type of the defect determines the powers of the court, respectively the court resolves the matter in substance only in case of wrongfulness.
